GENERAL TERMS AND CONDITIONS OF SALE

1. Acceptance of the general terms and conditions of sale and conclusion of the contract

1.1 The contract stipulated between Visconti and the Client shall be considered concluded with the acceptance of the order by Visconti. In the event of non-acceptance of the order, the Visconti company shall promptly notify the Customer.

1.2 By placing an order in the various ways provided, according to the order form present on the Site, the Customer declares to have read all the information provided to him/her during the purchase procedure and to fully accept these general terms and conditions, indicated in compliance with the provisions of art. 12 of Legislative Decree 70/2003 and art. 51 of Legislative Decree 206/2005, as amended by Legislative Decree 21/2014.

2. Purchase modalities

2.1 In order to complete the order, the Customer shall fill out the relevant form on the Site in its entirety and send it after having reviewed the Conditions, as well as the characteristics of the product and/or products he or she intends to purchase. The Customer shall also request to Visconti, if he wishes, the issue of a fiscal invoice for the purchase, pursuant to art. 22 D.P.R. n. 633/1972 by filling in the appropriate fields.

2.2 The correct receipt of the Order is confirmed by Visconti by means of an e-mail reply sent to the e-mail address communicated by the Customer. This confirmation message will summarise the purchase conditions and the data entered in the Order by the Customer, so that the latter can check them and, if necessary, communicate without delay the corrections of any errors.

3. Prices and Methods of Payment

3.1 The prices indicated on the website are to be considered inclusive of taxes and VAT. Any shipping costs or payment charges are in any case calculated in the shopping cart, once the items have been entered.

3.2 The following payment methods are available:

3.2.1 PAYMENT BY CARD

The customer may choose to pay the order by credit card or debit card. The credit cards accepted are: VISA, MASTERCARD, AMEX, Union Pay. We also accept payment by POSTEPAY and all rechargeable cards operating within the VISA circuit.

3.2.2 BANK TRANSFER

The customer may choose to pay the purchased goods by bank transfer by entering the IBAN indicated on the order confirmation page in the name of Visconti. In the reason for payment enter the order reference number confirmed in the e-mail.

3.2.3. PAYPAL PAYMENTS WITH PAY BY INSTALMENTS OPTION

Paypal is an absolutely secure online payment method that allows the customer to pay for the order by accessing his account directly, via payment confirmation. The account and credit card data linked to one's account are managed directly by Paypal, which will provide an email notification following payment. The Visconti company does not, in any way, have access to the data of the cards with which customers make payments. To meet the needs of all customers, Paypal offers the possibility of paying in 3 convenient instalments, without interest and without management costs for amounts from € 30.00 to € 2,000.00. Viewing and managing the due date of the instalments is possible by consulting the PayPal app in the section ''Show upcoming payments'': this also allows early payment at the buyer's wish, at no additional cost. Even in the case of instalment payments, PayPal protects all purchases in the event that the item does not arrive or does not match the description. Choosing payment by instalments is very simple: simply select Paypal as the method of payment; if available, the option ''pay in 3 instalments'' will appear; after receiving confirmation by sending a code to their mobile phone, the customer can complete the purchase.

3.3.4. COD

Payment shall be made upon delivery of the purchased products. Payment by cash on delivery shall entail an additional charge of €4.50 to be borne by the Customer for collection costs. 

4. Delivery of Products and Costs

4.1 All orders will be processed and shipped to the address indicated by the customer in the order; the Visconti Company uses couriers such as Poste Italiane, GLS and Bartolini and will dispatch all orders within 24-48 working hours at the cost, if any, indicated in the shopping cart before sending the order. Any delays in shipment will be promptly communicated to the customer. The Visconti company reserves the right to choose the courier for the shipment of orders, except for exceptions indicated at the customer's request. In addition, the Visconti Company reserves the right to accept requests outside the Italian borders, for which not only the shipping costs, but also the delivery times will vary.

4.2 The delivery times indicated by La ditta Visconti shall be considered purely indicative and any delays caused by the couriers of the destination branch shall not be attributable to the sender.

4.3 The pictures of the biscuits are indicative; therefore, different shades from those in the picture are not to be considered as a defect or error and are not attributable to the sender in terms of return.

4.4 Upon delivery of the products, the Customer shall check that the number of packages delivered corresponds to the number indicated on the consignment note affixed to the package and that the packaging is intact, undamaged or altered, including the sealing materials (adhesive tape or plastic straps). Any damage to the packaging and/or the product, or the mismatch in the number of packages or indications, must be immediately detected by contacting 0885 861110 or by writing on WhatsApp at 371 3948161. Any problems concerning the physical integrity, correspondence or completeness of the products received must be reported within 3 days of delivery, in the manner set out herein.

5. Right of Withdrawal

5.1 Pursuant to Article 52 of Legislative Decree No. 206/2005, later amended by Legislative Decree No. 21/2014, the Customer may withdraw from the purchase contract for any reason whatsoever, without the need to give reasons and without penalty, within 14 (fourteen) working days from the date of receipt of the products.

5.2 In order to exercise the right of withdrawal, the customer shall send La ditta Visconti a communication within the terms indicated to the e-mail address info@biscottivisconti.com.

5.3 In the event of withdrawal the Customer may send, at its own expense, the products to La ditta Visconti within 14 (fourteen) days from the withdrawal itself, to the following address La ditta Visconti, Via Kennedy, 32 - 71045 Orta Nova (FG). Alternatively, you may ask the customer service, after fixing the day, for a collection by one of our couriers. For the collection there will be a charge of € 8.00 from the amount paid by the customer. The goods must be returned undamaged, complete with all parts and in their original packaging. The Visconti company does not accept partial returns, therefore the right of withdrawal may apply to the product purchased in its entirety. If the goods are damaged during transport, the Visconti Company shall inform the Customer, so that he can file a timely complaint against the courier chosen by him and obtain the relevant refund; in such cases the product shall be returned to the Customer, against whom the request for withdrawal shall be cancelled. Visconti Company shall not be liable in case of damage, theft, loss occurred during the return shipment.

5.4 The Visconti Company shall refund the Customer the full amount already paid within 14 (fourteen) days from the withdrawal only after the object has been returned by means of a transfer procedure of the amount charged, using the same means of payment used by the Customer for the initial transaction, unless otherwise agreed. In any event, the Customer shall not bear any costs as a consequence of such refund.

5.5 In any event, the Customer shall forfeit the right of withdrawal in cases where Visconti establishes that:

- the returned product is not intact;

- the product is missing its original outer packaging and/or its original inner packaging;

In case of forfeiture of the right of withdrawal, Visconti will return the purchased product to the sender, charging him the shipping costs and the price of the product.

8.1 Personal data collected following the order confirmation will be processed by La ditta Visconti for the sole purpose of satisfying the Customer's express requests, in compliance with European Regulation 679/2016 and the privacy policy on the website.
