GENERAL TERMS AND CONDITIONS OF SALE

1. Acceptance of the General Terms and Conditions of Sale and Conclusion of the Contract

1.1 The contract entered into between Visconti and the Customer shall be deemed concluded upon Visconti’s acceptance of the order. In the event that the order is not accepted, Visconti will promptly notify the Customer.

1.2 By placing an order through any of the available methods, in accordance with the order form on the Website, the Customer declares that they have read all the instructions provided to them during the purchase process and that they fully accept these general terms and conditions, which are set forth in accordance with the provisions of Article 12 of the D.Lgs. 70/2003 and Article 51 of the D.Lgs. 206/2005, as amended by the D.Lgs. 21/2014.

2. How to Purchase

2.1 To complete the order, the customer must fill out the relevant form on the Website in its entirety and submit it after reviewing the Terms and Conditions, as well as the specifications of the product(s) they intend to purchase. The customer must also request that Visconti, if desired, issue a tax invoice for the purchase, pursuant to Article 22 D.P.R. No. 633/1972 by filling out the appropriate fields.

2.2 Visconti will confirm proper receipt of the Order by sending an email response to the email address provided by the Customer. This confirmation message will briefly summarize the terms of purchase and the details entered by the Customer in the order, so that the Customer can verify them and, if necessary, promptly notify Visconti of any corrections to errors.

3. Prices and Payment Methods

3.1 The prices listed on the website include all taxes and VAT. Any shipping or payment fees are calculated in the shopping cart once the items have been added.

3.2 The following payment methods are accepted:

3.2.1 CARD PAYMENTS

Customers can choose to pay for their order with a credit card or debit card. We accept the following credit cards: VISA, MASTERCARD, AMEX, and UnionPay. We also accept payments via POSTEPAY and all prepaid cards that are part of the VISA network.

3.2.2 BANK TRANSFER

The customer may choose to pay for their purchase via bank transfer by entering the IBAN listed on the order confirmation page, made payable to Visconti. Please include the order reference number provided in the email in the payment description.

3.2.3. PAYPAL PAYMENTS WITH THE "PAY IN INSTALLMENTS" OPTION

PayPal is a completely secure online payment method that allows customers to pay for their orders by logging directly into their account and confirming the payment. The account and credit card information linked to your PayPal account is managed directly by PayPal, which will send you an email notification after payment is processed. Visconti has no access whatsoever to the credit card information customers use to make payments. To meet the needs of all customers, PayPal offers the option to pay in 3 convenient installments, with no interest and no processing fees, for amounts ranging from €30.00 to €2,000.00. You can view and manage your installment due dates by checking the “View upcoming payments” section in the PayPal app; this also allows you to make early payments at your discretion, with no additional fees. Even with installment payments, PayPal protects all purchases in the event that the item does not arrive or does not match the description. Choosing to pay in installments is very simple: just select PayPal as your payment method; if available, the “Pay in 3 installments” option will appear; after receiving confirmation via a code sent to your cell phone, you can complete the purchase.

3.3.4. MARK

Payment must be made upon delivery of the purchased products. Cash-on-delivery payments incur an additional charge of €4.50, payable by the customer to cover collection fees.

4. Product Delivery and Related Costs

4.1 All orders will be processed and shipped to the address provided by the customer in the order; Visconti uses carriers such as Poste Italiane, GLS, and Bartolini and will fulfill all orders within 24–48 business hours at the cost, if any, indicated in the shopping cart before the order is submitted. Any delays in shipping will be promptly communicated to the customer. Visconti reserves the right to choose the courier for shipping orders, except in cases specified at the customer’s request. Furthermore, Visconti reserves the right to accept or decline orders outside of Italy, for which not only shipping costs but also delivery times may vary.

4.2 The delivery times indicated by Visconti are to be considered purely indicative, and any delays caused by the couriers at the destination branch are not the responsibility of the sender.

4.3 The images of the cookies are for illustrative purposes only; therefore, color variations from those shown in the photos should not be considered a defect or error and do not constitute grounds for a return.

4.4 Upon delivery of the products, the Customer is required to verify that the number of packages delivered matches the number indicated on the waybill affixed to the package and that the packaging is intact, undamaged, and unaltered, including the sealing materials (adhesive tape or plastic strapping). Any damage to the packaging and/or the product, or any discrepancy in the number of packages or the information provided, must be reported immediately by contacting the toll-free number 800-011012 or the number +39 0885 324944. Any issues regarding the physical condition, accuracy, or completeness of the products received must be reported within 3 days of delivery, in accordance with the procedures outlined in this document.

5. Right of Withdrawal

5.1 The Customer, as provided for in Article 52 of Legislative Decree 206/2005, as subsequently amended by the D.Lgs. 21/2014, the customer may cancel the purchase contract for any reason, without having to provide a reason and without incurring any penalty, within 14 (fourteen) business days from the date of receipt of the products.

5.2 To exercise the right of withdrawal, the customer must send a notice to Visconti within the specified time frame to the email address info@biscottivisconti.it.

5.3 In the event of withdrawal, the Customer may return the products, at their own expense, to La ditta Visconti within 14 (fourteen) days of the withdrawal, to the following address: La ditta Visconti, Via Kennedy, 32 – 71045 Orta Nova (FG) - IT. Alternatively, after scheduling a date, the Customer may request that one of our couriers pick up the items. A charge of €8.00 will be deducted from the amount paid by the Customer for the pickup. The merchandise must be returned undamaged, complete with all its parts, and in its original packaging. Visconti does not accept partial returns; therefore, the right of withdrawal applies only to the product purchased in its entirety. In the event of damage to the goods during shipping, Visconti will notify the customer so that they may promptly file a claim with the courier of their choice and obtain the corresponding refund; in such cases, the product will be made available to the customer again, and the request for withdrawal will be canceled. Visconti will not be liable for any damage, theft, or loss occurring during the return shipment.

5.4 Visconti will refund the customer the full amount already paid within 14 (fourteen) days of the cancellation, only after the item has been returned to our facility, by crediting the amount charged back to the customer’s account using the same payment method the customer used for the initial transaction, unless otherwise agreed. In any case, the customer will not incur any costs as a result of this refund.

5.5 In any case, the customer will forfeit the right of withdrawal if Visconti determines that:

- the returned product is not in good condition;

- the product is missing its outer packaging and/or original inner packaging;

If the right of withdrawal has expired, Visconti will return the purchased product to the sender and charge the sender for the shipping costs and the price of the product.
